Ex Quebec Court of Appeal judge Jacques Delisle, 86, is predicted to be back in court Friday morning to understand if the lawful proceedings against him will be dropped.
Judge Jean-François Émond will declare whether to move on with a new trial or throw the case out.
In 2012, Delisle was condemned for first-degree killing in the 2009 demise of his spouse. Marie Nicole Rainville was sentenced to life in jail with no parole for 25 years.
But the ex-judge always claimed his innocence, claiming that his wife of 49 years died by suicide.

In April 2021, federal Justice Minister David Lametti requested a retrial after new information regarding the case came to light. Lametti figured that “a miscarriage of justice likely occurred” in the case.
Delisle was released on bail soon after, pending his new trial. He had spent nine years in jail.
In November, at a hearing, Delisle’s attorneys claimed that the Crown’s experts made severe mistakes in the original pathology information that led to their customer’s conviction. They said those mistakes would make it hard to provide the fairness of a new trial. They also claimed there had been absurd uncertainties in the case. Crown prosecutors claimed a new trial is required because of the seriousness of the accusations.
This is not the first time Delisle has battled to overturn his conviction. He pleaded to the Supreme Court, which declined to hear his case in December 2013.
